About Deductible Law HB 2102
HB 2102 is a deductible law that went into effect in September of 2019. It is not an entirely new law, but instead a new version of an existing deductible law that is more carefully worded. Essentially, the law punishes contractors who don’t collect insurance deductibles from homeowners. Violating this law is a Class B misdemeanor, which can result in up to 180 days of jail time and/or a fine of up to $2,000. The law:
- Does not allow contractors to waive or promise to waive insurance deductibles
- Prohibits contractors from providing rebates that cover the cost of a homeowner’s deductible
- Prevents the contractor from assisting the homeowner in paying their deductible in any way
This law is considered a win for reputable contractors because it helps ensure that they get paid the entire amount of the insurance claim, and prevents shady contractors from stealing their business. Because of this law, most insurance companies will require proof of the homeowner’s deductible payment before releasing their portion of the repair funds.
